COMPANY LAW: Petitioners appeared in list of defaulting directors who were identified and not filed financial statement for three years

• Hence, petitioners filed a writ in nature of mandamus directing Registrar of Companies not to consider petitioner as a disqualified director under section 164(2)(a) and for a further direction to change status of petitioner in records of Registrar of Companies from list of disqualified directors and consequently unfreeze Directors Identification Number (DIN) and Digital Signature Certificate (DSC) of the petitioners.

• However, there was no legal right in favour of petitioners against being removed as a disqualified director or to restore Director Identification Number (DIN) and Digital Signature Certificate (DSC) of petitioners so as to enable Court to determine their legal right, thus, petitioner was to make a representation before Registrar of Companies as regards their claim for continuing with Director Identification Number (DIN) and Digital Signature Certificate (DSC) as well as to exclude their name from list of disqualified directors.
