V.S. Datey on Companies Act, 2013
  • Appointment of Auditor

by manish jain on Wednesday, October 10, 2018 at 01:19 PM

If an Auditor (Individual) has been appointed due to casual vacancy for one year, will it be counted as completion of one term of his appointment under section 139(2)(a) of the Companies Act, 2013 or he can further be appointed in the Annual General Meeting for subsequent 4 years making it a tenure of complete 5 years? Whether if an Auditor (individual) once appointment due to casual vacancy for one year can further be appointed in the subsequent Annual General Meeting for a period of 5 years.

for four years - surely - not advisable to appoint for five years though in my view legally appointment can be for five years as first appointment was not for any fixed term V S Datey
